Dry Creek Ranch Outfitters – Client Hunt Agreement


1. General Terms

1.1 This is a fair-chase hunt conducted in the mountains of Colorado. No guarantee is made or implied regarding the opportunity to harvest, see, or encounter game of any species.
1.2 The Client understands that weather, game movement, animal behavior, terrain, and hunting pressure are factors outside the Outfitter’s control.
1.3 This Agreement supersedes all prior representations, verbal or written, including statements made by staff, guides, websites, social media, or advertisements.
1.4 Client certifies they have read this Agreement in full and had the opportunity to ask questions before signing.

2. Outfitter Responsibilities

2.1 The Outfitter agrees to:

  • Maintain all required state and federal permits, authorizations, insurance, bonds, and licenses necessary to legally conduct guided hunts.
  • Provide hunt details including gear list, regulations, meeting instructions, and recommended preparation.
  • Supply camp lodging and meals (depending on hunt some packages meals and lodging are not included), and transportation between the designated meeting point and camp.
  • Provide a professional guide for each day of the scheduled hunt.
  • Assist with field dressing, caping, quartering, and transporting game to the designated meeting point.
  • Maintain a safe, organized, and legally compliant hunting camp.

2.2 Not Provided:
Sleeping bags, personal gear, personal weaponry, ammunition, optics, taxidermy, meat processing, coolers, shipping of meat or trophies, airport pickup, alcoholic beverages, or any service not explicitly stated.

2.3 Guide Authority:
Guides have complete discretion regarding safety, route selection, pursuit decisions, shot opportunities, tracking decisions, and termination of the day’s hunt if conditions become unsafe.

3. Client Responsibilities

3.1 Client agrees to:

  • Provide accurate personal information and pay all fees on schedule.
  • Possess a valid Colorado hunting license, hunter safety certification, and legal weapon compatible with state regulations.
  • Follow all federal, state, and local laws; all Outfitter rules; and all guide instructions.
  • Maintain physical fitness appropriate for high-altitude, steep, rugged terrain.
  • Refrain from alcohol or intoxicants during active hunting hours or prior to any hunt day.
  • Sign any required waivers, releases, medical forms, or landowner permission slips.

3.2 Hunting Area Restrictions:
Client must remain within the hunt area designated by the guide. Leaving the assigned area for any reason ends the hunt immediately with no refund.

3.3 Weapon Safety:
Client agrees to handle all weapons safely and accepts full responsibility for any damage, injury, or incident resulting from negligent handling.

3.4 Client Conduct:
Outfitter may terminate the hunt with no refund if the Client:

  • Violates any wildlife or firearm law
  • Behaves in a reckless, unsafe, or disrespectful manner
  • Endangers any person, livestock, or property
  • Acts aggressively toward guides, staff, or other clients
  • Arrives intoxicated or impaired

3.5 Property Damage:
Client is financially responsible for any damage caused to Outfitter equipment, vehicles, tack, livestock, cabins, tents, or gear due to negligence or misuse.

4. Payment, Cancellations, and Chargebacks

4.1 Deposit: Deposits are required to reserve hunt dates and are non-refundable under all circumstances.

4.2 Final Payment: Due August 1 of the hunt year. Failure to pay may result in cancellation without refund.

4.3 Rollovers:
Deposits may roll to the following season only if:
(a) Client gives 60+ days notice, or
(b) Client is unsuccessful in the license draw.
Rollovers may occur one time only.

4.4 No Refund Situations:
No refunds for:

  • Early departure
  • Failure to follow guide instructions
  • Violation of hunting or firearm laws
  • Injury, altitude sickness, or inability to continue due to physical condition
  • Weather, fire, drought, or migration changes
  • Unsuccessful harvest
  • Client dissatisfaction with guide, camp, or game movement

4.5 Force Majeure:
No refund guaranteed in the event of wildfires, closures, extreme weather, government action, or emergencies. Rescheduling is at Outfitter discretion.

4.6 No Chargebacks / No Payment Disputes:
Client waives all rights to credit card chargebacks, ACH reversals, bank disputes, or payment reversals for any reason.
If Client initiates a dispute, they are responsible for all fees, attorney costs, court costs, and damages. Jurisdiction is Custer County, Colorado.

5. Release of Liability, Assumption of Risk & Indemnification

5.1 Assumption of Risk: Client acknowledges the inherent dangers of hunting, mountain terrain, horses, weapons, wildlife, and unpredictable weather.

5.2 Release of Liability:
Client releases Dry Creek Ranch Outfitters LLC and associated parties from all liability for injury, illness, property damage, death, or loss, including ordinary negligence.

5.3 Indemnification:
Client agrees to defend and indemnify the Outfitter against all claims arising from the Client’s participation or conduct.

5.4 Medical Responsibility:
Client is responsible for their own medical conditions and authorizes emergency care at their expense.

6. Harvest Policies

6.1 Wounded Animal Policy: If blood is drawn or a hit is suspected, all efforts may be devoted to recovery.
6.2 Guides may prohibit unsafe, unethical, or long-distance shots.
6.3 Meat care after delivery to the meeting point is the Client’s responsibility.

7. Governing Law & Venue

This Agreement is governed by Colorado law. All disputes will be handled exclusively in Custer County, Colorado.

8. Colorado Parks & Wildlife Regulations (CPW Compliance)

8.1 Client Responsibility:
Client must read, understand, and comply with all CPW laws, including licensing, tagging, evidence of sex, CWD rules, salvage requirements, and weapon regulations.

8.2 Regulations Provided:
Outfitter may provide general guidance, but it is not guaranteed to be complete or current. Client must rely on official CPW publications.

8.3 Legal Compliance:
Client agrees to follow:

  • All CPW laws
  • Game boundaries
  • Weapon requirements
  • Carcass/transport rules
  • Hunter orange laws
  • CWD mandates

8.4 Violation Consequences:
Any violation or suspected violation may result in:

  • Immediate termination of the hunt with no refund
  • Reporting to authorities
  • Loss of future hunt privileges
  • Forfeiture of all funds

8.5 Indemnification for Violations:
Client indemnifies Outfitter for any fines, penalties, or losses resulting from Client violations.

8.6 Law Enforcement Interaction:
Client agrees to comply fully with all CPW and federal wildlife officers.

9. Client Conduct, Behavior, and Respect Requirement

9.1 Professional Conduct:
Client must act respectfully toward staff, guides, landowners, and other clients.

9.2 Prohibited Behavior: Grounds for immediate removal without refund:

  • Rudeness, disrespect, or verbal abuse
  • Harassment, threats, intimidation, or aggression
  • Yelling, fighting, or disruptive behavior
  • Interfering with other clients’ hunts
  • Refusal to follow guide instructions
  • Drunken behavior affecting safety or morale

9.3 Guide & Staff Authority:
Outfitter may remove Client from camp at any time for unacceptable behavior.

9.4 No Refund / Damages:
If removed for conduct violations:

  • No refund is issued
  • Client must leave immediately
  • Client is responsible for all resulting damages

9.5 Zero-Tolerance Policy:
Outfitter maintains zero tolerance for abuse, disrespect, or endangering others.

10. Transportation & Access Method Authority

The Outfitter retains full discretion to determine the safest, most practical, and most effective method of transportation for the hunt and for travel to and from camp. This may include, but is not limited to:

  • Horseback
  • ATVs/UTVs
  • Trucks or 4x4 vehicles
  • Hiking on foot

Transportation methods may be adjusted at any time based on weather, terrain conditions, wildlife movement, road access, safety concerns, equipment availability, or operational needs.

Client understands and agrees that:

  • The Outfitter’s decision on transportation methods is final,
  • Transportation type may change without notice,
  • No refunds or compensation will be issued due to changes in transportation method, and
  • Refusal to use the transportation method provided may result in forfeiture of the day’s hunt or entire hunt without refund.

11. Entire Agreement

Client acknowledges that payment of any deposit constitutes confirmation that Client has reviewed, understands, and agrees to all terms of this Agreement, including hunt description, license requirements, and limitations. No verbal representations supersede this Agreement.
